EU Artificial Intelligence (AI) Law passed by member states aims to 'promote the development and deployment of safe and trustworthy AI systems'



The European Council has passed an Artificial Intelligence (AI) Act , which aims to encourage the development and deployment of safe and trustworthy AI systems by private and public organizations across the European market, stimulating investment and innovation in AI while respecting the fundamental rights of EU citizens.

The AI bill was considered over a period of nearly three years and passed by a majority in a vote of approval by the European Parliament in March 2024.

Now, having finally received approval from the relevant ministers of each member state, the AI Act has been officially enacted.



The AI law is based on a draft proposal submitted by the European Commission in 2021 and sets out obligations regarding AI based on its potential risk and level of impact.

For example, AI systems that use cognitive behavioral manipulation or social scoring will be banned from the EU because the risks they pose will be deemed unacceptable, as will the use of AI for policing based on predictions from profiling or to classify people according to certain categories such as race, religion or sexual orientation.

In addition, to ensure the proper enforcement of the AI law, an 'AI Office' directly under the European Commission, a committee composed of independent experts, an AI Committee including representatives of Member States, and an Advisory Council to provide technical expertise to the AI Committee and the European Commission will be established.

In addition, any breach of the AI law will be penalized with a fine of up to 35 million euros or 7% of the company's annual worldwide turnover for the previous financial year, whichever is higher.



The AI law will be signed by the Presidents of the European Parliament and the European Council and will be published in the EU Official Journal in May 2024. It is scheduled to come into force 20 days after publication. Regulations will be applied two years after their enactment, except for certain regulations.
