The lawsuits against OpenAI and Microsoft were filed by the New York Daily News, Chicago Tribune,

Orlando Sentinel , Sun Sentinel , The Mercury News , Denver Post , Orange County Register and Pioneer Press . All of these newspapers share a common thread: they are all owned by the hedge fund Alden Global Capital .

The newspapers claim that 'OpenAI has used datasets containing newspaper text to train large-scale language models such as GPT-2 and GPT-3,' and that 'GPT-4 can output almost perfect versions of our articles depending on the user's prompts.' They also pointed out to Microsoft that 'OpenAI has copied information from newspapers without permission to create Bing search indexes, and has presented answers about articles in Copilot while removing advertisements that were originally attached to the articles.'

Based on these allegations, the newspapers filed a lawsuit in federal court in the Southern District of New York, alleging that OpenAI and Microsoft are using millions of copyrighted articles for training purposes without permission and for free.

An OpenAI spokesperson said, 'We take great care in our product and design process to ensure that we do not impede the work of news organizations. We are actively engaged in constructive partnerships and dialogue with many news organizations around the world to discuss concerns and propose solutions. Together with our news partners, we see great potential for AI tools like ChatGPT to deepen relationships between publishers and readers and improve the news experience.'

In the past, OpenAI and Microsoft have been sued by the major daily newspaper, The New York Times, for copyright infringement.
