Tennessee has a strong music industry, with over 60,000 people working in the music industry and over 4,500 live music venues. However, although conventional state laws protect artists' names, images, and portrait rights, their voices are not protected, allowing the appearance of fakes whose voices are reproduced using generative AI.

To this end, Tennessee is enacting a law called the Portrait and Image Security Act of 2024, or the ELVIS Act, which will add artist voices to protections in addition to existing name, image, and likeness protections. has been underway since January 2024.

The ELVIS Act replaces the Individual Rights Protection Act passed in 1984, and is the first in the United States to explicitly state that the human voice is protected. The scope of prohibition has been expanded further than before.



Previous individual rights protection laws only prohibited the use of artists' names and photos for advertising purposes, and did not include the unauthorized use of AI voices for performance purposes. The latest ELVIS law does not have any regulations regarding the scope of prohibition, so unauthorized use in media such as documentaries, songs, books, etc. may be prohibited.
