Bipartisan lawmakers introduce NO FAKES Act to hold individuals and companies accountable for creating, hosting, and sharing unauthorized AI deepfakes
On July 31, 2024, a bipartisan group of US lawmakers introduced the Nurture Originals, Foster Art, and Keep Entertainment Safe Act (NO FAKES Act) to the Senate, which would make it illegal to create deep fakes of people's voices or likenesses without their individual consent.

The NO FAKES Act would allow people to seek damages if their voice, face, or body is recreated by AI without their consent, and would hold individuals and companies legally liable for creating, hosting, or sharing unauthorized deepfakes, including those created by generative AI.
The NO FAKES Act also applies even after a person's death, and the rights to protect their voice and likeness will pass to their heirs or executors of their estate.
Senator Chris Coons, a Democrat who introduced the bill, said, 'Everyone has the right to protect their voice and likeness, whether they're famous or not. Generative AI can be used as a tool to foster creativity. But that doesn't mean you can copy someone's voice or likeness without permission.' Senator Amy Klobuchar also said, 'We're increasingly seeing deep fakes generated by AI in ads, images, music and videos without users' consent. We need laws as sophisticated as this rapidly evolving technology. The NO FAKES Act would establish rules to protect people from having their voices and likenesses copied through AI without their permission.'

'Creators and artists deserve protection from inappropriate impersonation, and this must be done at the national level.'

'I look forward to seeing support for this bill in many places, and we will work to get it passed into law as quickly as possible.'
