Nintendo loses lawsuit against 'Super Mario'

When Jose Mario Alfaro Gonzalez tried to trademark the name of his supermarket chain 'Super Mario,' Nintendo of America, the American subsidiary of Nintendo, claimed exclusive rights to the name 'Super Mario,' leading to a court battle between the two companies.

Trademarks are managed according to the product category, and Nintendo has already registered 'Super Mario' in the fields of games, clothing, collectibles, toys, school supplies, etc. However, the Super Mario trademark registered by Nintendo did not cover the food retail field of supermarkets, and as a result, Mr. Gonzalez's trademark registration was approved.


'I am very happy that we have won the Costa Rican trademark registration proceedings against an internationally renowned video game brand,' Gonzalez wrote in a Facebook post, thanking his legal counsel and the Costa Rican Investor Chamber for their support.

At the time of writing, Nintendo has not commented or issued a statement on the matter.
