X files lawsuit seeking injunction against law requiring 'response to political disinformation'; Elon Musk previously spread deep fake videos of Vice President Kamala Harris



X has filed a lawsuit in court seeking an injunction against the Defending Democracy from Deepfake Deception Act of 2024 (AB-2655), which was enacted in California.

AB-2655 is a bill introduced on February 14, 2024, that requires large online platforms to 'block false information about elections during election periods' and 'establish procedures for reporting false information.' In addition, if a platform violates AB-2655, public officials, election officials, the Attorney General, and the Chief District Attorney may request an injunction from the court, and the court must give priority to the request.

As the debate over AB-2655 was underway, Elon Musk spread a deep fake video of Vice President Kamala Harris on X in July 2024. In response, California Governor Gavin Newsom posted, 'This kind of behavior should be illegal. I will sign a bill within weeks to make sure this happens,' and signed AB-2655 on September 17, 2024.




It has now become clear that X has filed a lawsuit in court seeking an injunction against AB-2655 on November 14, 2024. In its lawsuit, X claims that AB-2655 violates the First Amendment, stating that 'AB-2655 would lead to widespread censorship of political speech' and that 'critical speech against government officials and candidates for public office has been strongly protected by the First Amendment.'

In addition, AB-2839 , a related bill to AB-2655, was injunctively blocked by Judge John Mendez on October 2, 2024 for alleged constitutional violations . AB-2839 requires courts to 'prioritize civil litigation proceedings when users or candidates request injunctions to stop false information,' but Judge Mendez argues that 'AB-2839 acts as a blunt instrument that unconstitutionally restricts the 'free and unfettered exchange of ideas' that is important to democratic debate.' Following Judge Mendez's injunction, Musk posted, 'California's unconstitutional violation of free speech has been blocked by the court.'
