On a Friday night in February 2021, Mr. Mark's wife called a nurse because his young son's penis was swollen and his son was in pain. A remote emergency consultation was immediately available the next morning, and the nurse told Mark's wife to send a picture of the affected area so the doctor could see it in advance.
Mark's wife took several pictures of his son's penis on Mark's smartphone. Among them, there were some that clearly showed that the affected area was swollen by shooting with Mr. Mark's hand. Mark's wife transferred the photos to her iPhone and uploaded them to the hospital's messaging system.
Thanks to the photos, the doctor was able to make a proper examination, and Mark's son was prescribed antibiotics and made a quick recovery.
However, two days after taking the photo, Mr. Mark received a 'policy violation' notice and the Google account was disabled. Mark was confused at first, but from his experience as a software engineer involved in the development of a tool that automatically deletes problematic content, he saw 'child sexual abuse and exploitation' in the reason, and the other day I realized that Google misidentified the photos of my son's infection as child pornography.
Mr. Mark immediately sent an explanation about his son's infection from Google's form, but a few days later, Google notified him of the decision not to revive Mr. Mark's account. No further explanation was given.
And in December 2021, Mr. Mark received a copy of the search warrant issued to Google and the ISP from the San Francisco Police Department and a document informing him that Mr. Mark was under investigation. The investigation concerns a 'child exploitation video' and was conducted less than a week after Mr. Mark photographed his son. Mr. Mark, who was surprised, contacted investigator Nicholas Hillard, but Hillard said that the case was resolved. Hillard's report concluded that 'the incident did not meet the elements of a crime, and no crime occurred in the first place.'
Mr. Mark asked Google to revive the account again with the police report, but Google did not respond.
According to Google's explanation, no rash or redness was detected in Mark's son's affected area, and it is also problematic that the infant was found sleeping on a bed with a naked woman six months ago in the first place. It was said that it was done. Mr. Mark doesn't remember the video, and he can't confirm it anymore, so he explains that he probably tried to record the happy moments of his wife and son, although the details are unknown.
Mr. Mark's Google account remains disabled, but since the San Francisco police have a backup of the data, Mr. Mark wants to somehow restore the data. A police spokesperson also said they wanted to help Mark.
Just like Mr. Mark, a case was reported in February 2021 at about the same time that the Google account was disabled because of a photo of a child taken to see a pediatrician. Mr. Cassio, a party, has filed an objection but has been rejected by Google.
