Mike Duffy, a special investigator for the Florida Department of Law Enforcement, commented on the lawsuit, saying, 'Today's AI companies have made a huge contribution to the evolution of the digital world. Protecting children means teaching them how to deal not only with the people on the other side of the screen, but also with AI designed to mimic humans. Parental vigilance must shift from simply monitoring who their children are talking to to ensuring they understand what their children are saying, because machines programmed to please humans can never replace the safety that human boundaries provide.'
In this lawsuit, Attorney General Usmayer argues that 'OpenAI and Mr. Altman prioritized speed of market entry and commercial gain over user safety, ignored repeated warnings from internal and external experts, and falsely guaranteed to users that products that promote and encourage harm, including self-injury and violence, were safe.'
The complaint also states that 'ChatGPT collects data from minors without proper parental supervision, leading to behavioral addiction and cognitive impairment, and making it prone to dangerous errors that OpenAI has actively downplayed.' Florida law prohibits unfair and flawed business practices, and the complaint argues that OpenAI's actions have been a continuous violation of this law, seeking accountability. Florida is seeking damages on behalf of its citizens and an end to the deceptive and dangerous practices described in the complaint.

In this lawsuit, OpenAI is charged with four counts of deceptive and unfair trade practices, two counts of negligence, two counts of product liability violations, one count of fraudulent misrepresentation, and one count of public nuisance.
In response, an OpenAI spokesperson issued a statement to the media saying, 'We understand that losing a child is the most devastating event a family can experience, and that the pain of such a loss is indescribable. AI is a new and powerful technology, and we believe that minors need adequate protection. That is why we have implemented industry-leading safeguards and policies. In particular, we have directly incorporated minor safety measures into our products. Specifically, we offer a more protected experience for minors, age prediction tools, a feature that automatically transitions users whose age is unknown to a more protected experience, and tools that allow parents to monitor their children's AI usage. We know that pointing out these efforts will not bring back the child who has passed away, but we are doing everything we can to properly address this issue.'
The lawsuit alleges that the perpetrators of the Florida State University shooting and the University of South Florida murder may have used ChatGPT.

Drew Psatelli, a spokesperson for OpenAI, told NBC News, 'The 2025 Florida State University shooting was a tragedy, but ChatGPT is not responsible for this horrific crime. ChatGPT simply provided factual answers to questions based on information widely available from publicly accessible sources on the internet, and did not encourage or promote any illegal or harmful activities.'
