The executive order states that the Attorney General 'shall not take any action to enforce the TikTok Ban Act or impose any penalties on any entity for 75 days from the date of the effective date of the Executive Order,' and 'shall not take any action to enforce the TikTok Ban Act or impose any penalties on any entity for any conduct that occurs during the 75 days after the effective date of the Executive Order.' This means that legal enforcement of the TikTok Ban Act will be suspended for at least 75 days from January 20, 2025.
The order also states that 'the Attorney General is solely responsible for investigating and enforcing the TikTok Ban. Therefore, any attempt by states or private entities to enforce the ban would be a violation of executive authority,' explicitly prohibiting state governments and other entities from independently enforcing the TikTok Ban.
In a statement posted on the White House official website, President Trump said, 'I have special constitutional responsibilities for the national security of the United States, the conduct of foreign policy, and other important executive functions.
