LinkedIn fined $510 million by Irish Data Protection Commission for non-compliance with GDPR in data handling for targeted advertising



The Irish Data Protection Commission (DPC) has decided to fine LinkedIn €310 million (approximately 51 billion yen) for 'sending information with users' consent to third parties for the purpose of targeted advertising' in a way that did not comply with the EU's General Data Protection Regulation (GDPR).

The issue originated in 2018 with a lawsuit filed in France by French digital copyright protection organization La Quadrature Du Net .

The complaint was handed over to the French data protection authority (DPC), which is responsible for monitoring Microsoft's compliance with the GDPR, and the DPC has been investigating the matter since August 2018.

LinkedIn claims that it was sending users' information to third parties for the purpose of targeted advertising, but did so with users' consent.

However, GDPR requires that any use of personal information must have an appropriate legal basis, and the DPC found that LinkedIn lacked that basis, and also failed to adequately inform users that their information was being used.

In light of this, the DPC has decided to impose a fine of €310 million on LinkedIn, the sixth-largest ever imposed in the EU for a GDPR violation, and LinkedIn has 30 days to appeal.

In response to the decision, LinkedIn issued a statement saying, 'We believe we are compliant with the GDPR, but will work to ensure that our advertising practices comply with this decision by the DPC's specified deadline (three months from now).'
