Privacy activist Alexander Hanff has filed a complaint with the Irish Data Protection Commission, pointing out that the ad blocker detection script used by YouTube violates the ePrivacy Directive.

The ePrivacy Directive is a data protection regulation passed in 2002 and amended in 2009. 'Directives' are instructions from the EU to member states to create laws in line with the directives, and the directives themselves are not legally binding. In 2018, the General Data Protection Directive (GDPR) was implemented as a new regulation to protect personal data, supplementing the ePrivacy Directive.

Mr. Hanff claims that even though YouTube's script obtains browser information, it uses that information without the user's consent. When I contacted the Irish Data Protection Commission, they did not agree to the claim, but they did agree to contact YouTube.

In response to an interview with The Register, the Irish Data Protection Commission acknowledged that it had received Mr. Hanff's complaint, but declined to comment on the content as it is currently under investigation.
