The future of TikTok in the United States is left to the Supreme Court, which will review whether the TikTok ban is unconstitutional, but according to Axios, the court is likely to uphold the bill.
During oral arguments on January 10, 2025, the Supreme Court justices stated that the bill may not violate the Constitution, stating that 'TikTok can continue to operate if it uses an algorithm other than ByteDance's' and 'Because ByteDance is a Chinese company, it is not protected by the First Amendment of the U.S. Constitution.'
This increases the likelihood that the TikTok ban will go into effect as scheduled, and if ByteDance does not sell TikTok by then, it will no longer be possible to use TikTok in the US.

If this happens, the apps won't disappear from your phone instantly on January 19th, but you won't be able to download new apps or receive updates from the app store, and they will eventually become unusable.
If Oracle, which manages TikTok's vast video library, were to decide to stop hosting it, the app would face a more abrupt shutdown, though Oracle could face a steep drop in its stock price if it did so.

According to a survey by the Pew Research Center, a US think tank, TikTok has 170 million users in the US, and only 32% of Americans support banning TikTok.
Still, the U.S. government's decision to enact a ban on TikTok is based on national security concerns about Chinese companies, including the spreading of false rumours and espionage.
TikTok responded by arguing that the forced withdrawal was unconstitutional and violated the First Amendment right to free speech.
If the Supreme Court upholds the TikTok ban, TikTok's last resort will be Donald Trump, who will take office as president on January 20. Trump led the ban on TikTok during his first term, but has indicated his intention to keep TikTok alive after his reelection.
